Terms of Service
These Terms of Service (hereinafter the "Terms") govern access to and use of the PilotScribe service (hereinafter the "Service"), operated by Mistral JS (hereinafter "PilotScribe," "we"). By creating an account or using the Service, you (hereinafter the "Customer") fully and unreservedly accept these Terms.
1. Purpose of the Service
PilotScribe is an online service that analyzes a business's website, identifies keywords relevant to search engine optimization, writes SEO-optimized blog articles, and automatically publishes them to a hosted blog, with a review window before each goes live.
2. Account
- Creating an account is required to use the Service. The Customer agrees to provide accurate information and to keep it up to date.
- The Customer is responsible for keeping their login credentials confidential and for any activity carried out from their account.
- The Customer must hold the necessary rights to the website they entrust to PilotScribe and, where applicable, to the Google Search Console access they authorize.
3. Subscription and Billing
- The Service is offered as a paid subscription. The rates in effect are shown on the website at the time of subscription.
- Billing and payments are processed by our provider Stripe. By subscribing, the Customer accepts Stripe's applicable terms.
- The subscription renews automatically at the end of each period, unless the Customer cancels before the renewal date.
- Except where mandatory law provides otherwise, amounts paid are not refundable on a pro-rata basis in the event of cancellation during a period.
4. Generated Content and Publishing Responsibility
- PilotScribe produces editorial content using artificial intelligence models. Despite the care taken, this content may contain inaccuracies.
- The Customer remains solely responsible for reviewing, validating, and publishing the generated content, as well as for its compliance with applicable laws (competition law, consumer law, intellectual property, regulatory disclosures specific to their industry, etc.).
- The review window allows the Customer to adjust or reject an article before it goes live. If the Customer does not take action within the specified time, they accept automatic publication.
5. Ownership
- PilotScribe retains all intellectual property rights relating to the Service, its technology, its interface, and its trademarks.
- Subject to payment of the subscription, the Customer holds the rights to use and publish the editorial content generated for their own website.
6. Availability and Changes
We strive to keep the Service available, without guaranteeing uninterrupted operation. We may evolve, suspend, or modify all or part of the Service, in particular for maintenance or improvement purposes.
7. Termination
- The Customer may cancel their subscription at any time from their account; cancellation takes effect at the end of the current period.
- We may suspend or terminate a Customer's access in the event of a breach of these Terms, fraudulent or unlawful use of the Service, or failure to pay.
8. Limitation of Liability
To the extent permitted by law, PilotScribe shall not be held liable for indirect damages, in particular loss of revenue, loss of search rankings, loss of data, or commercial harm, resulting from the use of or inability to use the Service. PilotScribe's liability, should it be incurred, shall in any event be limited to the amount of the sums actually paid by the Customer over the last twelve (12) months.
9. Personal Data
The processing of personal data is described in our Privacy Policy, which forms an integral part of these Terms.
10. Governing Law and Jurisdiction
These Terms are governed by French law. Failing an amicable resolution, any dispute relating to their interpretation or performance shall fall under the jurisdiction of the competent French courts.
